El-Farouk Khaki "For us it's disappointing, because there's no accounting for
homophobia. So the fact that there is no appeal mechanism really does
leave people at the whim of a decision maker who may not be very
sympathetic to them," says El-Farouk Khaki, a refugee and immigration
lawyer who sits on the Egale Canada board as well as Egal...e's legal
affairs committee.



Khaki ran as an NDP candidate for Toronto Centre in the last two federal elections.



"You need to have oversight and accountability that's accessible to
people, and right now, it's not accessible because the only option you
have if you receive a negative refugee decision is to go to the Federal
Court for a judicial review," Khaki adds. "A judicial review is much
narrower in scope than an appeal. It basically leaves out a lot of
people — it leaves them out to dry."

With a tie-breaking vote cast by the speaker, Bill C-291 died on third reading in the House of Commons Dec 11. The bill would have seen the creation of a long-overdue Refugees Appeal Division, leaving refugees no internal mechanism to fight bad decisions.

human rights lawyer El-Farouk Khaki, who specializes on
LGBT rights and has worked on Russian cases in the past,
says the situation in Russia and Eastern Europe is
interesting for a number of reasons.
“The
strategy may h...ave changed, but the hate has not,”
Khaki said from Toronto. “Now there are gay
bars in cities like Moscow but you can’t leave
at night because you face the risk of being attacked by
skinheads and gangs while the cops do nothing.”
“The
‘morality’ standards only apply to [LGBT
people] and not heterosexuals.”

While
Khaki {a gay activist, like Manji, and a one-time NDP candidate}
doesn'...t completely discount that a fanatic Muslim might want to do harm
to Manji, he says "sensationalism sells." He notes there is a strong correlation between vigorous book sales and an author in possible danger.
Khaki,
a Vancouver-raised lawyer who now specializes in refugee law in
Toronto, says Muslims would never deny Manji the right to identify
herself as a follower of Mohammed. Still, he questions Manji's motives
in doing so.
"In the end, Irshad says Islam has to answer to her.
It's very egotistical," says Khaki, a member of the Muslim Canadian
Congress. "It's all centred around her. I don't see a love of Islam.
She's like a 14-year-old private-school girl who's pissed off at her
friends and lashing out."
Khaki also says Manji cherry-picks her anecdotes in an intellectually suspect way. "She's
looking at the worst of Islam and comparing it with the best of
Christian or Jewish theory. She also doesn't grapple with issues of
race or colonialism."
Khaki says Manji's giving the false
impression she's one of the only Muslims in North America taking on the
excesses of reactionary Islam.
Other reformers, Khaki says, are also
challenging Islam's many fundamentalist leaders (especially those in
U.S.-backed Saudi Arabia) and actively advocating ijtihad.

complications in documenting or proving the validity of conjugal
relationships that have not been disclosed to friends and family, or in
